A Comprehensive Guide to Understanding Mediation Information and Assessment Meetings

The Mediation Information and Assessment Meeting (MIAM) process is a crucial step in finding out whether mediation is suitable for you and your family towards a resolution and if not to take a look at other options available.

Finding resolutions can be a daunting task during a family dispute or in dealing with divorce disputes. Whether it is financial divorce mediation or family dispute mediation it is often the best route to a mutual resolution in such scenarios, offering an alternative to lengthy court battles and initiate communication and understanding between parties.

The MIAM process also serves as a mandatory precursor to most family-related court proceedings particularly in divorce. Its primary goal is to provide an opportunity for parties in conflict to explore mediation as a means of resolving their disputes. MIAM sessions are facilitated by accredited mediators or family lawyers who guide individuals through the process, helping them understand the benefits and mechanics of mediation.

The Purpose of MIAM:

Exploration of Mediation: MIAM allows parties to learn about mediation and its potential benefits in resolving their disputes. It provides them with a clearer understanding of the mediation process, in that it is completely voluntary, confidential and outlines the role of the mediator.

Assessment of Suitability: Both of you will be required to undergo individual MIAMs with the same mediator to assess the suitability of mediation before scheduling the initial joint meeting.  Factors such as the willingness of parties to participate in mediation, and any power imbalances are carefully considered.

Encouragement of Communication: MIAM fosters communication between parties, even if they ultimately decide not to proceed with mediation. The process encourages open discussions and can help clarify issues and concerns, potentially paving the way for future resolution.

Compliance with Legal Requirements: Attending a MIAM session is a legal requirement before initiating certain family-related court proceedings, such as divorce or applying for child arrangements order. Compliance with this requirement demonstrates a commitment to exploring alternative dispute resolution methods before resorting to court litigation. If you believe mediation isn't suitable and opt for a court application, you will still require a Mediation Information and Assessment Meeting (MIAM) beforehand. This is because the application must be accompanied by a MIAM certificate, a service we can offer.

The MIAM Experience:

Undertaking the MIAM process, can be daunting with emotions often running high, and the anxiety caused by uncertainty. However, approaching the session with an open mind and a willingness to participate can lead to constructive discussions and potential pathways to resolution.

Active Participation: Active participation is key during the MIAM process. Be prepared to listen to the mediator's guidance and to express your thoughts, feelings, and preferences openly and honestly. Remember that the mediator is impartial and is there to facilitate constructive discussions and a mutual resolution.

Exploration of Options: Use the MIAM session as an opportunity to explore various options for a resolution. The mediator may suggest different approaches or techniques tailored to the specific circumstances of your family dispute. Be open to considering alternative solutions and be willing to compromise where necessary.

Decision-Making: Following the MIAM session, you will have the opportunity to reflect on the information discussed and decide whether to proceed with mediation. If mediation is deemed suitable and both parties agree to participate, further sessions will be scheduled to delve deeper into the issues and work towards a resolution.

The MIAM process serves as a crucial gateway to resolving family disputes amicably and efficiently. By providing parties with information, assessing suitability, and encouraging discussions, MIAM lays the groundwork for constructive family mediation or financial divorce mediation sessions that can lead to mutually acceptable outcomes.
